2.) Collection, processing, and use of personal data
2.1.) Personal data
Personal data are, i.e., your name, your phone number, your address as well as all data you provide throughout the ordering process at Fitshop B.V.
2.2.) Collection, processing, and use of your personal data
Data privacy is very important for us. Therefore, we adhere strictly to the legal requirements of the Federal Data Protection Act and the German Teleservices Act. We collect, save, and process your data for the whole processing of your purchase, including any possible later warranties, for our services, the technical administration as well as own marketing purposes. Your personal data are solely shared with or transmitted to third parties (i.e., carriers, logisticians, banks), when this is required for purpose of processing of contracts, of billing or for analysis of target groups or when you agreed beforehand. Depending upon your chosen method of payment, your data are subject to a credit check. After a successful check, the preferred method of payment is available. In individual cases, our customer data profiles are completed by further data, provided by a third party, which enable us to assess the target group. Fitshop does not sell any customer data or share these with other services. We use the amended customer profiles only for internal processes.
2.3.) Use of your data for marketing purposes
Besides processing your data for processing your purchase at Fitshop, we also use your data to communicate with you about your orders, special products or marketing promotions and to recommend you products or services you might be interested in.
You can object in total or for single activities to the use of your personal data for advertising purposes at any time, without arising of further transmission costs than those according to the base rates. Sending a message in text form to the contact data mentioned under number 1 is sufficient.
2.3.1.) After Sale dialog / After Sale
In the course of the buying process, you receive an automated email after the purchase, asking you to evaluate our products and us as a dealer. These evluations help us to adapt our service and our policy of range of goods and to provide our customers more attractive offers in the future.
2.3.2.) Newsletter
When you subscribe to the newsletter, your email address is used for own advertising purposes until you unsubscribe the newsletter. It is possible to unsubscribe at any time.
The dispatch of the Fitshop newsletter is done according to a double opt-in procedure, this means, we will just send you a newsletter, when you have explicitely confirmed beforehand that we shall activate the newsletter service.
If you want to unsubscribe the newsletter, you can withdraw your consent without arising of further transmission costs than those according to the base rates at any time. 2.3.3.) Product recommendations and offers by email
Being a customer of Fitshop, you receive intermittently information by email about offers and/or product recommendations. You receive these product recommendations from us regardless of whether you have subscribed a newsletter. This way, we want to provide information about products of our range of products, which might be of interest for you, based upon your last purchases with us.
If you do not wish to receive any product recommendations or any advertisement news from us any longer, you can object without arising of further transmission costs than those according to the base rates at any time. 2.3.4.) Individual advertisement for you
Information we receive from you help us to permanently improve your purchase experience and to create it individually and customized for you. We use this information exclusively in pseudonymized form. By analysing and interpreting this information, it is possible for us to improve our website and our Internet offer as well as sending you individual advertisement. This means advertisement recommending products which might be of real interest for you. It is our aim to create our advertisement more practical and more interesting for you. Therefore, the interpretation and analysis of your collected and pseudonymized data help us to send you interesting advertisement.

2.3.5.) Raffles, promotion, market and opinion research
Regarding raffles and offers, we use your personal data to contact you in case you win a prize and possibly to mention the winner of a raffle/an offer. Find detailed tips in our conditions of participation about the respective raffle/promotion.
Furthermore, we use your data for market and opinion research. Of course, we use these exclusively in anonymized form for statistical purposes and solely for the Fitshop B.V.
2.4.) Klarna data protection regulations
2.4.1.) Use of personal data for selecting Klarna as method of payment
When you have decided for Klarna's payment service Klarna invoice as option of payment, you agreed that we collected and transmitted the following personal data to Klarna like first name and surname, address, day of birth, gender, email address, IP address, phone number for processing the purchase on account and an identity and credit check as well as data, which are related to the order like number of articles, article number, billing amount, and taxes in percent required for processing the purchase on account. The transmission of these data is done in order for Klarna to be able to prepare an invoice and do an identity and credit check for processing your purchase according to your desired invoice processing. According to the Federal Data Protection Act, Klarna has a legitimate interest in transmission of personal data of the customer and requires these to obtain information for purpose of identity and credit check from credit reporting agencies.

Besides an address check, Klarna also collects and uses information about the previous payment performance of the customer as well as probability values regarding this performance in the future within the scope of the decision on reasoning, implementation or termination of the contractual relationship. The calculation of these score values by Klarna is carried out on the basis of a scientifically approved, mathematical-statistical procedure. Klarna will use your address data for this purpose, among other things. In case, it turns out that your solvency is not given due to this calculation, Klarna will inform you about this immediately.
2.4.2.) Withdrawal of use of personal data towards Klarna
1. You can withdraw your consent for the use of personal data towards Klarna at any time. Although, where required, Klarna remains entitled to process, use, and transmit the personal data, in so far it is required for payment transaction by contract by Klarna's services, it is legally required or this is demanded from a court or an agency.
2. Of course, you can receive information about personal data saved by Klarna at any time. This right is guaranteed by the Federal Data Protection Act. If you want this as customer or wish to communicate amendments regarding the saved data to Klarna, please contact datenschutz@klarna.de.
3.) Cookies
Accepting cookies is not a prerequisite to visit our webshops. We point out that using the shopping cart function and ordering products is solely possible, when you allow us to place cookies.
3.1.) What are cookies ?
Cookies are little text files which are temporarily or permanently saved on your hard disk and which save special preferences and data for exchange with our webshops. Temporary cookies are deleted directly after your visit, permanent cookies remain for a longer period of time or without time limit.
The storing helps us to appropriately create our webshop and our offers for you and facilitates the use of our website for you.
3.2.) Which cookies are used by Fitshop ?
Most cookies used by us are temporary ones and are automatically deleted on your hard disk after ending the visit. These cookies are required, i.e., to offer you the shopping cart function over several sites.
Furthermore, we use permanent cookies which remain on your hard disk. When you visit our website again, it is automatically recognized that you have already been on our site and which articles you put in the shopping cart. These permanent cookies are saved on your hard disk and delete themselves after the given time.
3.3.) Which data are saved in cookies ?
Personal data are not saved in the cookies used by us. Cookies cannot be traced back to a certain person/email address or to you. When the cookie is activated, an identification number is given to it. An allocation of your personal data (name, your IP address or similar information) regarding this identification number is not possible at no time and is not done. We solely receive pseudonymized information, i.e., which sites of our shops were visited, which products were looked at, etc. on the basis of the cookie technology.
3.4.) Third-party cookies
Fitshop makes use of some advertising partners, which help to create the Internet offer and the Fitshop webshop more interesting for you. Therefore, cookies of partner companies are also saved when the Fitshop webshop is visited. These are temporary/permanent cookies (see 3.1. What are cookies ?), these cookies delete themselves automatically after a given time.
Cookies of our partner companies also do not contain personal data. Data are solely pseudonymously collected under a user-ID. These are data regarding, i.e., which products were looked at, whether something was purchased, which products were searched for, etc.. Here, some of our advertising partners also collect information beyond the Fitshop website about which sites you visited before or which products you were interested in, i.e., in order to present the advertisement to you which meets your interests the best possible. These pseudonymous data are at no time combined with your personal data.
3.5.) Third-party cookies (Re-Targeting)
Our website uses so called Re-Targeting technologies. We use these technologies to create the internet offer more interesting for you. This technology makes it possible to approach to Internet users, who were already interested in our shop and our products, with advertisment on the websites of our partners.We are convinced that showing a personalized, interest-related advertisment is generally more interesting for the Internet user than advertisement, which does not have such a personal reference.
Showing this advertising material is done on the basis of a cookie technology and an analysis of the previous user behaviour - advertisement is absolutely pseudonymous. Personal data are not saved and user profiles are not combined with your personal data.

4.) Web analysis
We use so called tracking technologies in order to improve and optimize our offer continuously. We use the services of Google Analytics and Piwik for this purpose.
4.1.) Google Analytics
This website uses Google Analytics, a web analysis service of the Google Inc. ("Google"). Google Analytics uses so called "cookies", text files, which are saved on your pc and which enable an analysis of your use of the website. As a rule, the information produced by the cookie about your use of this website is transmitted to a server of Google in the US and is saved there. In case of activating the IP anonymization on this website, your IP address is shortened by Google within the member states of the European Union or in other contractual states of the convention of the European Economic Area beforehand. On rare occasions, the complete IP address is transmitted to a server of Google in the US and is shortened there. In addition, we use the technologies of the Piwik Web Analytics Tool for statistical analysis of this website. Data collected by means of Piwik are anonymously saved on the servers of Fitshop. There is no connection done between your personal data and your browsing behaviour.
5.) Use of Social Plugins
Some sites of our webshop might contain a function, which members of social networks (i.e., Facebook, Google+) use to transmit an information to the social network via a button. If you do not want this, visit our webshop without being logged in at one of these social networks.
6.) Right of information of the person affected
According to the Federal Data Protection Act, our customers are entitled to, i.a., free information about their saved data as well as they are possibly entitled to amendment, blocking or deletion of data.
